How long does a DUI stay on your record in California?

  2. admin Said,

A DUI will stay on your record for 10 years in California. It used to be 7 years, but the latest change in legislation increased it to 10.

  3. mwilliams Said,

What happens if I refuse to take the chemical test, if I have been arrested for driving under the influence?

  4. admin Said,

    From the DMV site:
If you were 21 years of older at the time of arrest and you refused or failed to complete a blood or breath test, or (if applicable) a urine test:

A first offense will result in a 1-year suspension.
A second offense within 10 years will result in a 2-year revocation.
A third or subsequent offense within 10 years will result in a 3-year revocation.
If you were under 21 years of age at the time of being detained or arrested and you refused or failed to complete a PAS test or other chemical test:

A first offense will result in a 1-year suspension.
A second offense within 10 years will result in a 2-year revocation.
A third or subsequent offense within 10 years will result in a 3-year revocation.

  8. Joe Bishop Said,

Does any one know how long it takes after a DUI to get your license suspended?

  9. admin Said,

It depends. The court will order a suspension once you have plead guilty/no contest to DUI charge; or, the DMV will suspend once you have had a hearing and they have found that the officer had probable cause to stop you and that you were driving with a BAC of .08 or above. Your lawyer could have the suspension run concurrent. Either way, the DMV should notify you prior to the beginning of the suspension. If this is your first DUI, you will probably be eligible for a restricted license after 30 days that will allow you to drive to and from work ONLY (not school) during the course and scope of your employment, and to and from your alcohol class. Hope this helps. For further information please contact http://www.notojail.com
