Even though there is no law requiring you to identify the driver, most police departments, and even some courts, will tell you that you must. However, that is not true. Hiring an attorney to appear for you and contesting identity will bypass that issue. However, you will probably be ordered into court on the date of the trial. If it’s clear from the picture that it is really not you, then the ticket will be dismissed. If it’s not clear, then the officer has to prove beyond a reasonable doubt that it is you. California Vehicle Code Section 210 requires that the photo be “clear.” Unfortunately, a judge evidently has a lot of latitude as to what “clear” means. I got a red light camera ticket, however you can’t really tell that it is me. What happens if I send it back saying it wasn’t me? It says I have to tell them who it is.
